These Terms of Service (the "Terms") govern your access to and use of Hifiverse.io, the Hifiverse mobile applications and any related services we offer (together, the "Service" or the "Platform"). The Platform is operated by Timelapse Games EOOD, a single-owner limited liability company registered in the Republic of Bulgaria under unified identification code (UIC) 207599711, VAT number BG207599711 ("Hifiverse", "we", "us" or "our").

These Terms form a binding contract between you and Hifiverse. By creating an account, accessing the Platform, posting any listing, subscribing to a paid plan, purchasing an Authentication, or otherwise using the Service, you confirm that you have read, understood and agreed to these Terms together with all policies referenced below.
If you do not agree to these Terms, you must not use the Service.
Hifiverse is an online platform that lets users discover, research, value, list and connect regarding hi-fi audio equipment. We provide editorial content, a price index built on aggregated public data, collection-tracking tools, marketplace listings, dealer storefronts, an authentication service operated through partner technicians, and (from time to time) data and API services.
Hifiverse is a connection platform. When users list items for sale and other users contact them, the resulting transaction is concluded directly between buyer and seller. Hifiverse is not a buyer, a seller, an auctioneer, an escrow agent, a payment processor, a shipping carrier, an insurer or a warrantor in any Marketplace Listing or any sale that may result. We do not collect, hold, transmit or refund any payment between buyer and seller.
Hifiverse is a contracting party only in respect of the services we provide directly to you, which we call "Platform Services": subscriptions, the Authentication Service, dealer-storefront features, API and data licences, and editorial services. Platform Services are paid for through Stripe and are governed by these Terms together with the relevant supplementary policy.
You may use the Service only if all of the following are true:
If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation.
To use most features you must create an account. You must provide accurate, current and complete information and keep that information up to date. You are responsible for everything that happens under your account. You must keep your password confidential and notify us immediately at info@hifiverse.io if you suspect any unauthorised access.
You may have only one personal account. Account sharing, account transfer and account resale are prohibited unless we expressly authorise the transfer in writing.
You may close your account at any time from your account settings.

We may add, change, suspend or discontinue any feature at any time.
When you post content on the Platform ("Your Content"), you remain the owner. You grant Hifiverse a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, reproduce, adapt (for technical purposes), display, distribute and use Your Content for the purpose of operating, promoting and improving the Service.
You confirm and warrant that Your Content is your own work (or you have all rights needed to post it), does not infringe any third-party rights, is accurate and not misleading, and is not unlawful, defamatory, harassing, deceptive, threatening, obscene or otherwise prohibited under our Acceptable Use Policy.
All material on the Service that is not Your Content is owned by Hifiverse or licensed to us. We grant you a personal, non-exclusive, non-transferable, revocable licence to access and use it for ordinary use of the Service. You may not copy, scrape, redistribute, sell, frame or reverse-engineer any part of the Service except as permitted by mandatory law or under a written agreement such as the API Terms of Use.
Where you choose a paid Platform Service, the price is shown to you before purchase and is processed by Stripe Payments Europe Limited. Stripe is the only payment processor we use, and Stripe processes payments only for Platform Services — not marketplace transactions between buyers and sellers.
Detailed terms governing each paid Platform Service are set out in the Subscription Agreement and the Refund & Cancellation Policy, incorporated by reference into these Terms.
You agree to use the Service in good faith and in compliance with the Acceptable Use Policy, the Marketplace Listing Terms, the Community Guidelines, the DAC7 / Tax Reporting Policy (if you are a seller) and all applicable laws.
Where you list items for sale, you are solely responsible for any income tax, VAT, customs duty or other tax obligation arising from your sales. Hifiverse is a digital platform operator within the meaning of EU Council Directive 2021/514 (DAC7) and may be required to collect specific information about you and to report it annually to the Bulgarian National Revenue Agency. See the DAC7 / Tax Reporting Policy for the full framework.
The Service is provided "as available". We cannot guarantee uninterrupted operation, the accuracy of every Price Index entry, the truthfulness of any listing or review, or the suitability of any item for any specific purpose.
The Price Index is a reference tool only — not a valuation prepared by a qualified valuer, an offer, a recommendation, financial advice, or insurance advice.
The Authentication Service is an inspection at a specific point in time — not a warranty, insurance policy or guarantee of future performance.
12.1 Mandatory consumer rights. If you are a consumer in the EU, EEA, UK or another jurisdiction with mandatory consumer rights, nothing in these Terms limits or excludes those rights.
12.2 We are not liable for marketplace transactions. Hifiverse is not a party to any sale between users and is not liable for any act, omission, breach, default, fraud or loss attributable to a buyer or seller.
12.3 We are not liable for third-party services.
12.4 What we are liable for. We accept liability without limit for fraud, gross negligence, wilful misconduct, death or personal injury caused by our negligence, and any other matter that cannot lawfully be excluded.
12.5 Cap on other liability. Subject to section 12.4, our aggregate liability to you for all claims in any 12-month period is limited to the greater of (a) the fees you actually paid Hifiverse for Platform Services in the preceding 12 months, or (b) €100. We are not liable for indirect, consequential, special, exemplary or punitive damages.
We may suspend or terminate your access if you breach these Terms or any referenced policy, if we reasonably believe your account is being used for fraud or unlawful purposes, if you repeatedly violate the Acceptable Use Policy, if you fail to provide required information, or if continued provision would breach a law.
Where we take a moderation action, we will provide a Statement of Reasons and you may appeal through the internal complaint mechanism described in the Notice-and-Action / Copyright / DSA Policy.
14.1 If you have a complaint, contact us first at info@hifiverse.io. We aim to acknowledge within five working days and resolve within thirty days.
14.2 EU consumers may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.
14.3 Governing law. These Terms are governed by the law of the Republic of Bulgaria, without regard to its conflict-of-law rules. Consumers also retain the protection of the mandatory provisions of the law of their country of residence.
14.4 Jurisdiction. The courts of Sofia, Bulgaria have jurisdiction, but EU consumers may also bring proceedings in the courts of their country of residence.
14.5 US arbitration. If you are a US resident, disputes will be resolved by binding individual arbitration administered by JAMS. This does not apply to EU/EEA/UK consumers.
We may update these Terms when the Service changes, when the law changes, or for legitimate business reasons. For significant changes we will notify you at least thirty days in advance by email and on the Platform. The current version is always at hifiverse.io/policy/terms.
16.1 Entire agreement. These Terms, together with the policies they reference, are the entire agreement between you and Hifiverse.
16.2 Severability. If any provision is held to be unenforceable, the rest stays in force.
16.3 No waiver. A failure to enforce a right is not a waiver of it.
16.4 Assignment. You may not assign these Terms without our written consent. We may assign to a successor entity.
16.5 No agency. Nothing in these Terms creates a partnership, agency, joint venture or employment relationship.
16.6 Force majeure. We are not liable for failure or delay caused by events outside our reasonable control.
16.7 Notices. Notices to you may be given by email to the address on your account or by posting in the Platform. Notices to us must be sent to info@hifiverse.io.
16.8 Languages. Published in English. If there is a conflict between the English version and a translation, the English version prevails.
