These Marketplace Listing Terms ("Listing Terms") govern listings on the Hifiverse marketplace. They form part of the Terms of Service. They apply to anyone who creates a listing on hifiverse.io, regardless of subscription tier.
You may create a listing only if:

These limits count active listings at the same moment, not lifetime listings. If a listing closes, the slot opens immediately.
Anyone whose pattern of activity is consistent with a business must subscribe to a Dealer plan:

When you try to add a listing beyond your tier's limit, we show a soft-block screen explaining your options. We do not silently block you and we do not delete your existing listings.
We may reach out to a user whose pattern of selling is structurally that of a dealer. The signals we look at (none of which is determinative on its own) include: 10 or more identical or near-identical listings in a 90-day window; 5 or more items with commercial-style language; structural off-platform commerce signals; crossing of DAC7 thresholds.
Individuals selling down a long-held private collection are not "traders" under EU consumer law even if the collection is large.
Required or optional fields when creating a listing:
Listings are active for 90 days. Before expiry we email you and offer a one-click renewal.
You can mark a listing as:
Marking a listing as Sold feeds the Price Index (anonymised). You may opt out of Price Index contribution when marking an item Sold.
You may not "freshen" a listing by deleting and recreating it to game search ranking — that is a violation of the Acceptable Use Policy.

You must grade honestly. Photos must support the grade.
Hifiverse is not a party to any sale that results from a listing on the Platform.
In particular:
Off-platform contact is allowed. After a buyer contacts you, both parties may continue the conversation off the Platform — by email, phone, instant messenger, or in person. We do not penalise this.
We are a contracting party only in respect of Platform Services: subscriptions, Authentications, dealer storefronts, API and data products, sponsored content.
You may not list:

You may upload only photos and descriptions to which you have rights. You may not use manufacturer stock photographs for used items (unless an authorised dealer), photos belonging to other sellers, or copyrighted material you do not have permission to reproduce.
You grant Hifiverse a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, display and use your photos and descriptions for the purpose of operating the Service.
You set your own price. We display the Hifiverse Price Index value next to your listing for reference. You may price above or below the Price Index. We do not set minimum or maximum prices and do not enforce manufacturer-recommended retail prices.
When a buyer clicks "Contact Seller" or "Make Offer", we route the inquiry to your registered email. We retain the lead record for moderation and dispute reference per the Privacy Policy.
After a transaction concludes, both parties may leave a review. Reviews must be honest, reflect first-hand experience and comply with the Community Guidelines.
The thresholds we use: 30 sales or €2,000 in consideration in a calendar year. When you approach the threshold, we ask you for information required by DAC7. Until you provide this information, we may suspend your listings. See the DAC7 / Tax Reporting Policy for the full framework.
Business sellers (dealers, professional sellers, anyone selling in the course of a trade) owe consumer buyers a statutory two-year minimum guarantee against non-conformity under EU law. You cannot waive this in your listing.
Private sellers (consumers selling their own personal items, not in the course of a trade) owe much less. A model clause you can include verbatim:
Sold as a private seller. To the maximum extent permitted by law, all warranties of merchantability, fitness for purpose and non-conformity are excluded. The item is sold "as seen and tested" with the defects (if any) described in the listing. The buyer is invited to inspect the item before purchase.
This clause does not override any non-waivable rights the buyer has under the law of their country.
Note on German "Privatverkauf — keine Gewährleistung". This clause is effective for genuine private sales, but the German BGH has held it may be void under §444 BGB if the seller acts in a quasi-commercial pattern. If your selling pattern places you in this borderline area, consult a German lawyer before relying on the clause.
We may remove a listing or suspend an account if the listing breaches these Listing Terms, the Acceptable Use Policy or the Community Guidelines; the listing is the subject of a credible Notice-and-Action notice; or we reasonably believe the listing involves fraud, counterfeit, theft or money laundering.
When we remove a listing or take an account action, we send a Statement of Reasons explaining what happened and your right to appeal.
For material changes, we give 30 days' notice. Minor changes (typos, clarifications, additions to the prohibited list that reflect existing law) may take effect on publication.
